General terms and conditions of business

§ 1 Contracting parties

Rechtwerk GmbH Rechtsanwaltsgesellschaft not only acts as an intermediary, but also often handles delivery itself using its own tanker fleet. Through our website, we connect heating oil consumers with our partner dealers and also offer our own flexible delivery service. This way, our customers benefit from both ordering directly from our partner dealers and reliable delivery through our own network.

Purchase contracts and any claims arise primarily between the partner dealer and the purchaser/user. If Rechtwerk GmbH Rechtsanwaltsgesellschaft acts as the supplier itself, we ensure smooth processing and timely delivery.

§ 2 Conclusion of contract

By clicking the „Buy now“ button, you place a binding order for the selected product. Confirmation of receipt of the order will be sent immediately after submission.

The purchase contract between the user and Rechtwerk GmbH Rechtsanwaltsgesellschaft or one of our partner retailers is only concluded upon a separate order confirmation via email or telephone outside of our platform. This confirmation will be sent within 5 days at the latest.

§ 3 Revocation

There is no statutory right of withdrawal for the purchase of heating oil, as these deliveries are dependent on fluctuations in the energy and raw material markets. According to Section 312g Paragraph 2 No. 8 of the German Civil Code (BGB), the right of withdrawal is excluded for consumers, meaning that declarations of intent regarding the purchase contract cannot be revoked.

§ 4 Prices and delivery conditions

The invoice amount is calculated based on the specified delivery quantity. If the actual quantity purchased deviates by more than 10%, the partner dealer can adjust the price accordingly. For bulk orders, the price quote is only valid if the delivery points are within 15 km of each other. Hose lengths exceeding 40 meters or difficult delivery conditions must be stated when ordering. The delivered heating oil quantity is determined and billed using a calibrated flow meter on the tanker truck, temperature-compensated to 15°C.

§ 5 Payment on account

If the user is offered the payment option „invoice“ or „cash on delivery,“ this is subject to a positive credit check by our partner dealer or Rechtwerk GmbH Rechtsanwaltsgesellschaft. For new customers, a deposit of 50% of the order value is required.

§ 6 System failure

Rechtwerk GmbH Rechtsanwaltsgesellschaft  does not guarantee the constant and uninterrupted availability of the website and the ordering system or for any damages that may arise from this.

§ 7 Market information – legal information

Rechtwerk GmbH Rechtsanwaltsgesellschaft  reserves the rights to the published market information, charts, and prices. Storage in databases, publication, reproduction, or distribution to third parties, as well as any commercial use, are prohibited without express written consent. Despite careful research, no guarantee can be given for the accuracy of the information.

§ 8 General Liability and Warranty

Rechtwerk GmbH Rechtsanwaltsgesellschaft  assumes no liability or warranty for contracts between users and partner retailers. In particular, we are not liable for the characteristics, quality, or availability of the agreed services, nor for direct or consequential damages. By submitting a binding order, users confirm that their information is true and complete.  Rechtwerk GmbH Rechtsanwaltsgesellschaft  reserves the right to verify this information at any time through its own research.

§ 9 OS platform for disputes

Alternative dispute resolution pursuant to Art. 14 (1) of the ODR Regulation and Section 36 of the VSBG (Consumer Dispute Resolution Act):
